The Standing Committee of the State Council held on November 23rd passed the "Anti-Unfair Competition Law of the People's Republic of China (Revised Draft)". The draft has improved the legal definition of unfair competition. Experts said that this will crack down on unfair competition in accordance with the law, protect the legitimate rights and interests of operators and consumers, and create a fair market environment conducive to entrepreneurial innovation.
Wang Jiangping, deputy director of the State Administration for Industry and Commerce, said that the connotation of competition policy is to respect the laws of the market and to make the market play a decisive role in the allocation of resources to a greater extent and in a larger scope. Effective implementation of competition policy is a key measure to solve the problems of unbalanced, uncoordinated and unsustainable economic development in China at present, and is of great significance for further improving China's socialist market economy.
Wang Jiangping said that the national industrial and commercial and market supervision departments have continuously deepened the reform of the commercial system in recent years, creating favorable conditions for more market participants to participate in competition fairly. At the same time, we will strengthen post-event supervision and continue to carry out anti-monopoly and anti-unfair competition law enforcement in areas closely related to people's livelihood.
From April to October of this year, the State Administration for Industry and Commerce carried out special enforcement actions on centralized rectification of public enterprises to restrict competition and monopoly behavior. In the special action, if the industrial and commercial departments found that there are still illegal activities in the enterprises that have been investigated, they will be severely punished according to the anti-unfair competition law and the anti-monopoly law. As of June 30 this year, the national industrial and commercial authorities have filed 478 cases and closed 118 cases according to the anti-unfair competition law, with a case value of 270 million yuan and a fine of 27.38 million yuan.
The meeting pointed out that the draft supplemented the provisions on combating commercial bribery, strengthening trade secret protection and anti-unfair competition in the Internet field, strengthening civil liability, and increasing credit punishment and administrative punishment for illegal acts.
Nie Dong, an expert at the Ali Research Institute, said that there are many cross-border competitions in the Internet field, and cross-border competition will occur between products of different platforms. It is necessary to promote the solution of these problems, thereby promoting the development of the entire Internet industry and helping China's Internet sector enterprises to compete internationally.
